Phil Ivey Files Suit Against TiltWare, Not Playing WSOP

It is difficult to conceive of Phil Ivey even using Facebook, but the poker pro actually turned to the social networking site to speak out for the first time since Black Friday.  In a series of statement’s on his official fan page, Ivey not only condemned Full Tilt Poker for the way the site has handled repaying customers since the Department of Justice seizure, he also revealed he was suing the site and sitting out the 2011 World Series of Poker until Full Tilt customers get their funds returned.

For many years, I have been proud to call myself a poker player. This great sport has taken me to places I only imagined going and I have been blessed with much success. It is therefore with deep regret that I believe I am compelled to release the following statement.

I am deeply disappointed and embarrassed that Full Tilt players have not been paid money they are owed. I am equally embarrassed that as a result many players cannot compete in tournaments and have suffered economic harm. I am not playing in the World Series of Poker as I do not believe it is fair that I compete when others cannot. I am doing everything I can to seek a solution to the problem as quickly as possible.

My name and reputation have been dragged through the mud, through the inactivity and indecision of others and on behalf of all poker players I refuse to remain silent any longer. I have electronically filed a lawsuit against Tiltware related to the unsettled player accounts. As I am sure the public can imagine, this was not an easy decision for me.

I whole heartedly refuse to accept non-action as to repayment of players funds and I am angered that people who have supported me throughout my career have been treated so poorly.

I sincerely hope this statement will ignite those capable of resolving the problems into immediate action and would like to clarify that until a solution is reached that cements the security of all players, both US and International, I will, as I have for the last six weeks, dedicate the entirety of my time and efforts to finding a solution for those who have been wronged by the painfully slow process of repayment.

Ivey was a no-show at the $25,000 Heads-Up Event on the opening day of the 2011 World Series of Poker prompting many to question where he was. The above statements began appearing on his Facebook page shortly after 8 pm PT Tuesday. BLUFF has independently confirmed that the statements have come directly from the Phil Ivey management team, which includes Joe McGowan.

jasont says:

how is this filing suit. It looks like your saying he is suing tilt.

I think ivey is not playing because he is a part owner of tilt , whether he denies it or not

Bob says:

“Your” and “you’re. Not the same, jasont. You should look it up, or go back to school.

bob is dumb says:

Bob u r an idiot… Plus you are the one using incomplete sentences, also u don’t know how to use commas correctly. So maybe u can both can take an English class together.

Awesome of Ivey to stick up for us!

Joe Cogan says:

Read the paragraphs in reverse order. Facebook puts new posts over older ones. It was too large to post all at once, so whoever posted this for Phil broke it up so that it would read properly from top to bottom.

Dana says:

You might want to check your grammar before criticizing someone else Bob. I find using incomplete sentences shows a greater lack of education.

Wait sorry Bob let me rephrase in terms you understand.

Criticize someone. Go back school when not checking words, will, you.

Bryan says:

Wow. All I can see is a guy who is stabbing the people who made him ungodly rich in the back so that he can look good when they all look like shit. Way to jump ship, your lawsuit will do nothing to get people paid out faster and will probably only hinder the process. People need to chill out, its only been 6 weeks! Neteller took 9 months, and honestly, and playing in the post UIGEA world, I have no sympathy for delays in payouts, nor can I get mad about my money frozen.

JM says:

You have the post(s) out of order, here they are in the correct order:

I wholeheartedly refuse to accept non-action as to repayment of players funds and I am angered that people who have supported me throughout my career have been treated so poorly.

standing up for bob says:

Incomplete sentences are greater errors than misspelling a basic English contraction? You are mistaken.

Brian says:

Kudo’s on Phil for taking a stand. For those say FTP made him ungodly rich I’d say Andy Beal (think that’s the bankers name), Macau, Atlantic City and his play in Bobby’s room did that.

Roger says:

People are foolish to leave thousands of dollars in a poker account online. I also have no sympathy for these people. I’d be willing to be a good percentage of these people, that was all the money they had, and now they cant get it…..LOL I swear people blow my mind sometimes in trusting thier money on a poker website. This is a hard lesson learned. Get a “real job” people. Stop worrying about where to find your next game, and go out and do the world some good with a job that helps people

Dana says:

Incomplete sentences are definitely greater errors. I’m sure you love speaking to people in broken English?

It’s easier to notice and correct an incomplete sentence than over looking a contraction. Also he didn’t misspell the word he just used the incorrect word.

Just because it’s a “basic” or “simpler” error doesn’t mean it’s a greater error.

Kevin says:

My personal rule is that the first person who turns a debate into a spelling bee automatically loses the debate.

Rob says:

U R ALL DUMB. HOW’S ABOUTS THAT?

Ben says:

Roger, go preach to some other choir. No one cares about your elitist, airheaded views. The fact of the matter here is that one site (Pokerstars), did everything they could to get their players the money which was rightfully theirs. The poker sites are the parties responsible for this shutdown, not the players. Accordingly, it should be the sites, not the players, who should take the fall. The execs at Pokerstars realized this immediately. It seems the people at Tilt are having difficulty realizing this.

Miranda says:

I have to agree with Kevin! Keep the grammar lessons off the poker sites. If you feel that strong about it– go start a blog somewhere! Honestly! Anyways, from what I’ve read is that FLTPKR is a foreign owned site. They essentially were caught laundring money back into U.S. banks. I could be wrong. However his actions are admirable, but won’t have any effect on money being returned in a timely manner.

Samal Joensen says:

He is doing something…! This is better then nothing…! If some of the other FTP team members would join him…maybe that would help…! there is not much that can be done! I am a EU player, but there are problems here also with withdraw,4 weeks since i cashed out,but still no money and unable to get any response from support! hopefully US players will get the cash, but this site better left alone,be it US/EU players!

One who had Phil Ivey on Fantasy Team says:

FML!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Say it ain’t so Phil Ivey. I spent 40% of my units on you; and now you are not even playing? FTP, please pay all US players so PI can play WSOP, so that I have a chance at winning the prop bet. FML!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

jf says:

I’m sure that full tilt is probably really stressed about Phil missing a game…..lol. its just like boycotting Walmart because the drive through clerk at taco bell didn’t give you your change.

Erwin says:

Roger, dismount that high horse. I can’t tell what your angle is, chances are you have moral problems with poker and gambling and grab any opportunity of other peoples’ misfortune to rejoice. It would point to a very dark character trait.

Steph says:

1. Stop it with the grammar patrol!
2. Roger- I could go on a huge rant as to why your statement is so incredibly false, but I don’t have the time to waste on short-minded people like yourself that obviously have little to no experience in the matter at all.
3. Bryan- you’re also ridiculous for your post. If you think he’s doing this to look godly (as if he’s not godly enough as it is!), you have no idea who Phil Ivey is. If you think that his boycott is going to have no impact on FTP or the poker industry, you also have no idea who Phil Ivey is.
4. I literally went O_O when I heard about this news- the greatest overall player in the world not playing in the biggest series in the world? Absolutely unbelivableeee… but if anything is bound to have an impact on FTP, this is it.
5. FTP- HURRY UP AND PAY OUT SO THAT PHIL IVEY (and others) CAN PLAY WSOP!
6. Haha I bet Ivey still cashes the most even if he starts 3 weeks and 35 events into the series… =P

mucklebuck says:

I’m not sure I understand why Ivey is earning praise for this – does the WSoP own Full Tilt? The WSoP is already losing a huge pool of players with online tournaments gone, so how does one of the big names opting out help anyone? Sounds like he wanted to avoid being yelled at.

SteveB says:

Anyone know what jurisdiction the suit was filed in, and maybe a file number?

JustBlazed says:

Kudos to Phil for doing the RIGHT thing in this instance. FullTilt will undoubtedly be hounded with new questions, specifically from the mainstream media who really only focus on the WSOP as far as poker news is concerned outside of the card world.

There is more to this than we even know and to speculate that this won’t impact FullTilt at all is very shortsighted. Apparently, they need to free up capital to pay back all the players which to me, doesn’t make much sense considering those funds should have been held in a seperate, escrow account. The only shady thing going on this whole time was FullTilt’s business practices which Phil has now stood up to, who wants represent a company that can’t even pay its customers money owed?

peter griffin says:

can this thread get back to the fucking topic. idiots talking grammar…. this is a post as to why phil is doing what hes doing. not a fucking 2nd grade spelling test. so lets keep the posts on point instead of off.

Jim Groot says:

I applaud Ivey no matter why he did it. I would like to see the WSOP step up and announce that the Full Tilt brand cannot be displayed during the event. This is an American event and Full Tilt is currently screwing American players.

Arturo Fuente says:

WOW!! What a great Phil Ivey. To me he is a rat escaping sinking ship. No class, no decency. What he is doing is called “damage control”. Why he is not playing – may be because he is affraid he will be arrested while showing up at WSOP. FTP is trying to pay back. They are not stupid to damage their reputation. It will cost them more in future. They can’t pay out of frozen accounts. Stars kept player’s funds separately on accounts that were not touched by DOJ. Clear and simple.

victoryv111 says:

i apparently tho he is suing TILTWARE LLC ..OR does this mean hes suing Howard leader Chris ferguson and himself??? who APPARENTLY .own shares in FULL TILLT .TILTWARE .founded by Raymnond bitar original foundeR .APPARENTLY of TILTWARE LLC.. …MMM APPARENTLY based in Alderney..or other..APPAERENTLY ..
JUS GIVE UP THE MONEY…LOL
PS. MAYBE PHIL CANT GET TO HIS MONEY EITHER OR IS THAT APPARENT??? LOL

TSG says:

THINK YOUR ALL MISSING THE POINT!GREAT PLAYER OR NOT! POKER IS NOT GOING TO BE THE SAME WITH OR WITH OUT PHIL IVEY!MONEY SOONER OR LATER!DOESN”T CHANGE THE FACT USA IS NOT A PLACE TO GOVERN POKER.STOP IT WHY?LOTS OF REASONS MAINLY NO tax dollars!and no want to govern it!sucks !or not!

QuietBen says:

“Where there’s a will, there’s a way.” PokerStars had the will and found a way to pay all its players within a reasonable time period. FullTilt has only issued verbal assurances which over time become meaingless and empty. Even non-US players are complaining about withdrawals from FullTilt now. They have become questionable until proven otherwise and their brand/logo should be banned from display at WSOP events until confidence is restored.

dono says:

Everyone who played online knew it was illegal and knew the risks and did it anyway. I hope players get their money back, but if they don’t, that was the risk they took.

Filling in for Bob says:

victoryv111, you really need to learn to use capital letters more effectively. And your spelling, is atrocious.

English teacher says:

At mucklebuck:
Why would the WSOP be losing players if all us players are in the casinos rather than online? I’m sure people are smart enough not to put their whole br on their account and leave no room for live play. The online satelite tournaments will just have to go the EU/CAN players. He is being praised for this because he is the one that was expected to stand up for fellow US players and getting their money back. He said it was taking too long, so he did it. I give him much respect for what he did.

One who had Phil Ivey on Fantasy Team says:

I am suing Phil Ivey for negligent and tortuous interference with prospective economic advantage. I spent over 40% of my units to acquire him for my WSOP fantasy poker team. His decision to not play is costing me equity.

He probably didn’t want idiots coming up to him every hour of every day going on about Full Tilt and Black Friday.

He might end up playing the main event though… maybe he will adopt a disguise aka Phil Laak!

The truth says:

US players should sue FT too as Ivey reconmends. If Dwan and others are willing to be grantees for a new loan so be it, Ivey doesnt have to do that. Right now his money for shares has been put to sleep. The deals that have been made need to come into the light.

How can the WSOP be held in a country that treats and views poker this way.

Kristine says:

THANKS IVEY FOR TAKING A STAND AT LEAST ONE OF THE PROS is using his connections. WHY HAVENT THE REST FOLLOWED???? aka Daniel, Durr, ETC ETC so sad. Just want to play the game I Love….NO WSOP because my funds are frozen what a horrible year.

I guess we just have to wait until the facts and truth come out really

all the players do seem to be doing a damage controll thing right now

and the more it seems to work for the ones coming out and doing so…the more that will step forward and do it

but again, until the facts and truth come out eh

and lol at the grammer police ha ha ha

“oops someone just misspelld a word there and didnt write his comment like it was a formal letter…best write them a whole formal comment telling them about it”

pathetic
